HONG KONG.

I have the honour to address Your Lordship on the

subject of the terms on which Crown Land should be leased for

the erection of churches, chapels and similar religious

buildings.

The case of St. John's Cathedral can at the outset

be removed from this discussion as the site of that building

is held by certain trustees in fee simple under the terms of

section 6(1) of Ordinance 2 of 1930.

In subsequent cases there has been a noticeable

lack of uniformity in this matter. In some cases there has

been a free grant of land at a nominal Grown Rent; in others

there has been sale by public auction without restrictive

covenant, and Crown Rent at the usual commercial rate for the

locality chosen. Between these extremes there have been cases

of sale by private treaty at normal upset prices with nominal

Crown Rent; sales by public auction with a nominal Crown Rent

so long as the site is used for a church with a proviso that

full normal Crown Rent will be charged if such user ceases;

and minor variations.

What is perhaps of even greater importance is the

fact that, while many of such preferential grants have had
